The following Rental Terms and Conditions (the “Terms”) are applicable to all rentals of Equipment (as defined in Section 3 below), and all rental contracts, quotations, order acknowledgements, and invoices from Climax Portable Machine Tools, Inc. including any rentals of products produced under the CLIMAX, BORTECH, CALDER, and H&S TOOL brands (hereinafter collectively “Climax”) and to all related purchase orders from Climax’s customer (“Customer”). Climax’s quotation (the “Quote”), rental contract, invoices, and Customer’s credit application, together with the Terms (collectively, the “Agreement”) are the only terms and conditions applicable to the rental of Equipment.
