Boulder District Attorney Anne Kelly admitted in Boulder Court on August 12, 2020 that Boulder immigration attorney Emily Cohen is innocent and was subjected to malicious prosecution in 2015.
The Boulder District Attorney told the judge, "Everybody knows that. This is not a mystery. The prosecution overstepped in that case." Anne Kelly is quoted here telling the court that the former elected Boulder District Attorney Stan Garnett, who has since resigned, "took steps that were well out of bounds of what they should have done." The Colorado Court of Appeals unanimously reversed the 2015 Boulder jury’s findings, with over a dozen legal errors made by Boulder District Court Judge Andrew Hartman.
District Attorney Anne Kelly admitted in a subsequent hearing that the Boulder District Attorney’s office destroyed evidence and Brady material as District Attorney Stan Garnett resigned.
